Welcome to Cinematch ("Service"), a personalized content recommendation platform provided as both a website and a mobile application. These Terms of Service ("Terms") govern your access to and use of Cinematch. The Service is operated by an individual based in Illinois, USA ("we," "us," or "our").
By accessing or using Cinematch, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
3.1. To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
3.3. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.4. Current Features: As a registered user, you can participate in personalization surveys and input your content preferences to receive personalized content recommendations. These features are provided free of charge as the platform is currently in development.
3.5. Beta Version: Cinematch is currently in development and will soon enter its beta testing phase. During this phase, all services will remain free of charge. We appreciate your understanding that the Service may undergo changes and improvements during this period.
4.1. Age Requirement: Cinematch is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old.
4.2. Account Termination: If we discover that a user is under the age of 13, we reserve the right to immediately terminate and delete their account without prior notice.
4.3. Content Advisory: While Cinematch allows users as young as 13 to create accounts, we do not have stringent age-gating controls. Certain content recommended by our Service may not be suitable for younger audiences.
4.4. External Data: Cinematch uses external data from TMDB (The Movie Database). Some content may be categorized as mature or adult-oriented based on TMDB data.
4.5. Parental Responsibility: Parents or guardians of minor users are responsible for monitoring their children's use of the Service. We encourage parents and guardians to supervise their children's internet use and to teach them about safe online practices.
4.6. No Liability: Cinematch is not liable for any mature content that may be viewed by users, including minors. Users access all content at their own risk.
4.7. Future Features: We may implement content filtering options in the future. Any such features will be clearly communicated to users, and these Terms of Service will be updated accordingly.
5.1. Future Monetization: While all services are currently free, we plan to introduce monetization features in the future. These may include:
a) In-App Purchases: We may offer the ability to make one-time purchases within the Service.
b) Subscription Plans: We may introduce subscription-based access to certain features or content.
5.2. Notice of Changes: We will provide notice of any monetization changes before they take effect. Continued use of the Service after such changes will constitute your acceptance of the new terms.
5.3. Beta Testing: Prior to full monetization, we may conduct beta testing of new features. Participation in beta testing will be subject to additional terms provided at that time.
6.1. The Service and its original content (excluding third-party data), features, and functionality are and will remain the exclusive property of Cinematch and its licensors. This includes, but is not limited to, the Cinematch logo, visual design, and layout.
6.2. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cinematch.
7.1. You retain any and all of your rights to any content you submit, post, or display on or through the Service ("User Content").
7.2. By posting User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.
8.1. We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Service ("Feedback").
8.2. You acknowledge and agree that if you submit any Feedback to us, we may use and implement such Feedback at our sole discretion without any obligation to compensate you.
9.1. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9.2. We specifically reserve the right to terminate and delete the account of any user who is discovered to be under the age of 13, without prior notice.
9.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
In no event shall Cinematch, nor its owner, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
These Terms shall be governed and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
